DECLARATION AND RELEASE FORM

 

TERMS AND CONDITIONS

I, the Participant, do hereby represent, warrant and agree as follows:

1. I hereby represent and warrant that the Participant is at least 18 years of age or older as of the date of the submission of my Video Audition.
2. Neither I nor anyone I live with is an employee of any of the following entities: the Producer; the Broadcaster; or any of their respective subsidiaries, related, affiliated or parent companies; their respective advertising and promotional agencies, and/or sponsors; any person or entity connected with the production, administration or judging of the auditions or the Program.
3. I acknowledge and understand that due to time constraints and the number of submitted entries the Producer receives, there is no guarantee that the my Video Submission(s) (or however many Videos I submit) will be accepted for consideration to be showcased on the Program's Segment entitled "World Dancing" and/or on the Program's website. Furthermore, I agree that the Producer and its respective parent, subsidiary, affiliated and related companies, and its assignees and licensees are hereby irrevocably released and discharged from any and all liability and responsibility in this regard.
4. I have not and will not enter into any commercial or other sponsorship agreement or arrangement with any person, firm or company with respect to my appearance and/or participation in the Video Audition.
5. I hereby assign irrevocably to the Producer the entire copyright and all other rights of whatsoever nature in and to my Video Audition, or any other contribution to my Video Audition, including without limitation, my Video Audition, online performance and/or video recorded performance, any comments made by me(whether as part of the audition, performance(s), or as an interview) and any incidental inclusion of my name, age, biographical information, voice, photograph, image and/or likeness, howsoever caused, such that the Producer shall be entitled to use and exploit, and license others to use and exploit, such Video Audition, my name, age, biographical information, voice, photograph, image and/or likeness and/or contribution(s), in whole or in part, by all means and in all media and formats, whether now known or hereafter invented, throughout the universe, for the full term of copyright and thereafter, insofar as is possible (including any renewals thereof) in perpetuity. Furthermore, I irrevocably waive any and all moral rights to the extent that they may be waived, including without limitation, the rights of integrity, attribution and association, to which I am now or may later become entitled to, in any part of the world, and grant any additional rights under the Canadian Copyright Act (and any amendment or re-enactment thereof) (the "Act") and under all similar or other laws in any part of the world that may create rights in my performance(s) on the Video Audition, including without limitation any and all personality and privacy rights, to enable the Producer to make fullest use of my Video Audition, without restriction.
6. Without limiting the foregoing in any way, the Producer shall be entitled to: (a) edit, alter, adapt, make additions to or deletions from, juxtapose with other footage and synchronize with music the Video Audition (and the Participant's performances therein), at its discretion, and I hereby unconditionally and irrevocably waive the benefit of any provision of law known as "moral rights" prevailing now or in the future in any part of the world, to the extent it may be waived;.(b) make and exploit and to authorize the making and exploitation of any recording or fixation of my performance(s) separately from or in conjunction with the Video Audition and the Program, throughout the Universe, including but not limited to performance in public and communication to the public by telecommunication or otherwise, in perpetuity, in all media whether now known or hereafter invented; (c) dub my voice in any language; and (d) include, or choose not to include, my name, image, likeness, performance, voice, biographical details, photographs of me and recordings of interviews with me, separately from or in conjunction with the Video Audition, in all media and formats throughout the Universe including, without limitation, advertising and publicity materials.
7. I acknowledge that no fees, royalties, residuals or other consideration will be payable to me (or anyone on my behalf) in respect of any broadcast, subsequent rebroadcast or retransmission or any other use by the Producer (or any assignees or licensees) of the Video Audition, without limitation, or any part thereof in any manner or media now known or hereafter invented, throughout the Universe, in perpetuity.
8. The Producer nor any of its parent, subsidiaries, affiliates, related companies, advertisers, sponsors, assignees and licensees shall not be liable to me, or to my legal representatives, my estate, executors, or heirs, for any loss or damage or injury to me or my property, caused by or suffered during or in connection with my taking part in the Video Audition and/or its inclusion in the Program, including without limitation, as a result of personal injury, invasion of privacy, libel, defamation or infringement of copyright.
9. I agree not to disclose to any third party (other than our professional advisors) any information relating to the Video Audition or the affairs of the Producer, broadcaster, (or any assigned company) that may come to my knowledge during or in connection with my participation in the Video Audition.
10. The Producer may assign this Release, including all rights to the Video Audition and all other rights in my contribution to and participation in the Video Audition and/or Program, to any of its parent, subsidiary, affiliated or related companies, assigns, licensees or successors in title, or to any other third party.
11. The Courts of Ontario shall have sole jurisdiction in relation to the terms and conditions of the agreement contained in this release, which shall be interpreted according to the laws of Ontario and the laws of Canada applicable therein, without regards to conflict of laws.
12. I am not currently a member of any performing arts union, guild, or signed to a collective bargaining agreement.
